Eligibility

Account and Use of Services
Each user is allowed to maintain only one account. Multiple accounts intended to circumvent our free subscription
model are prohibited. Accounts are personal and not to be shared with others. You are responsible for maintaining
the confidentiality of your account and password, including but not limited to the restriction of access to your
computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under
your account and/or password.
Content Restrictions
We prohibit the upload or dissemination of audio files that cater content which is illegal or generally defined by
law as offensive, including any discriminating, hateful, or harmful content.
File Retention Policy
Depending on your subscription plan, the retention period for your files varies:
- Free Plan: Files are retained for 1 month after the last active
use. If not accessed or used within this period, files will be automatically deleted.
- Flexible Plan: Files are retained for 6 months post the
last active use. Inactive files beyond this period will be subject to deletion.
- Beginner Plan: Files are maintained for up to 9 months of
inactivity. Post this period of inactivity, files will be securely deleted.
- Professional Plan: Files are maintained for up to 12 months
of inactivity. Post this period of inactivity, files will be securely deleted.
- Studio Plan: Files are maintained for up to 12 months of
inactivity. Post this period of inactivity, files will be securely deleted.
This policy is part of our commitment to data privacy and efficient resource management. Ensure to
backup or download files if you wish to retain them beyond the specified periods for your respective plan.
Fair Usage Policy
At LemonSpeak, we’re committed to providing exceptional service to all our customers. To ensure fair access and use
of our resources, we’ve established the following Fair Usage Policy as part of our terms.
Our pricing plan is designed to accommodate the typical usage needs of most podcasters. Based on the plan you
subscribed to you are entitled to a specific number of minutes of service usage. We understand, however, that your
needs may vary, and sometimes, you might need more.
Should your usage exceeds this amount within a billing period, an overage rate of $0.15 per minute will apply. This
rate is designed to cover the additional resources required to support your extended usage while allowing us to
maintain the high-quality service you expect from us.
We encourage you to monitor your usage through "Your Plan" to manage your subscription effectively and avoid
unexpected charges. Should you have any questions about this policy or need further clarification, please don’t

Intellectual Property Rights
All content, trademarks, service marks, trade names, logos, and intellectual property (whether registered or
unregistered) are owned by us or our licensors. Except as explicitly provided herein, nothing in these Terms shall
be deemed to create a license in or under such Intellectual Property Rights. The intellectual property rights of any
uploaded podcast or content, as well as any output generated by our service, will remain with the original owner and
will not be claimed by us.
Data Privacy and Sharing
In alignment with the General Data Protection Regulation (GDPR), we prioritize the confidentiality and integrity of
your personal data. Our use and sharing of data are strictly limited to purposes essential for the provision of our
services. We only share data to support operational needs, such as improving service delivery, maintaining our
infrastructure, and ensuring the security of our services. We explicitly avoid sharing your data with third parties
that might exploit it for unrelated marketing or profit-making activities.
When data sharing is necessary, it is conducted under stringent agreements that enforce data protection and privacy
standards compatible with our commitments and legal obligations. We aim to be transparent about our data practices,
providing you with control and choice regarding your data. You retain the right to access, amend, delete, or restrict

Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall LemonSpeak, its affiliates, directors, or
employees be liable for any direct, indirect, punitive, incidental, special, consequential, or exemplary damages,
including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses arising
out of or relating to the use of, or inability to use, the service.
Payment Terms and Consequences of
Non-Payment
Payment Obligations: By subscribing to any of our plans, you agree to fulfill all payment obligations
associated with
your selected subscription and any additional charges incurred due to overages as specified in our Fair Usage
Policy.
Payments are due on the billing date specified in your subscription plan, and failure to make timely payments may
result in suspension or termination of services.
Consequences of Non-Payment: In the event that any payment is denied, fails, or is disputed by you without a
valid and lawful reason, LemonSpeak reserves the right to take one or more of the following actions:
- Account Suspension or Termination: We may immediately
suspend or terminate your access to our services.
Suspended accounts will not have access to any stored data or the service features until all outstanding payments
are fully settled.
- Legal Action: LemonSpeak retains the right to initiate
legal proceedings to recover any outstanding amounts.
This may include but is not limited to, the use of collection agencies or taking legal action in a court of law.
- Late Fees and Charges: A late fee may be applied to any
outstanding amount that remains unpaid beyond the due
date. Additionally, interest may accrue on any unpaid balance at the maximum rate permitted by law.
Reactivation: To reactivate a suspended account, all outstanding balances must be paid in full, including any
applicable late fees and additional charges.
We urge all our customers to maintain open communication with us regarding any billing issues or disputes. We are
committed to working with you to find a reasonable solution to any payment-related issues that may arise.
By using our services, you acknowledge and agree to these payment terms and the potential consequences of
non-payment.
Changes to These Terms
We reserve the right to modify these Terms at any time. We will post the most current version of these Terms on our
website. Your continued use of our services after the new Terms become effective means you agree to the new Terms.
Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the country where our company is
registered.
